การตราพระราชกฤษฎีกา รัฐมนตรีซึ่งมีหน้าที่เกี่ยวข้องจะอาศัยอำนาจตามรัฐธรรมนูญ พระราชบัญญัติ หรือพระราชกำหนดนั้น ๆ เสนอร่างพระราชกฤษฎีกาต่อคณะรัฐมนตรีให้พิจารณา โดยร่างพระราชกฤษฎีกานั้น จะต้องไม่ขัดต่อรัฐธรรมนูญ พระราชบัญญัติ หรือพระราชกำหนดที่เกี่ยวข้อง

เมื่อคณะรัฐมนตรีพิจารณาแล้ว จะต้องนำร่างพระราชกฤษฎีกาขึ้นทูลเกล้าฯ ถวายพระมหากษัตริย์เพื่อทรงตราพระราชกฤษฎีกานั้น ๆ นายกรัฐมนตรีจะเป็นผู้รับสนองพระบรมราชโองการ จากนั้นจึงนำไปประกาศในพระราชกิจจานุเบกษาบังคับใช้ต่อไป

พระราชกฤษฎีกาที่สำคัญ ได้แก่ พระราชกฤษฎีกาให้เลือกตั้งสมาชิกสภาผู้แทนราษฎร พระราชกฤษฎีกายุบสภาผู้แทนราษฎร พระราชกฤษฎีกาเลือกตั้งสมาชิกวุฒิสภา พระราชกฤษฎีกา เรียกประชุม/ปิดประชุม/ขยายเวลาประชุม สภาผู้แทนราษฎร.
