ข้อหารือ	: เกษตรกรชาวสวนยางและพ่อค้าคนกลางซึ่งเป็นบุคคลธรรมดาในหลายจังหวัดของ ภาคตะวันออกเฉียงเหนือ ได้นำยางแผ่นและน้ำยางที่ได้จากต้นยางพาราไปขายให้แก่บริษัท ท.สาขา ซึ่ง มีสำนักงานใหญ่ตั้งอยู่ที่กรุงเทพมหานคร และเป็นผู้ประกอบการที่อยู่ในการกำกับดูแลของสำนักบริหารภาษี ธุรกิจขนาดใหญ่ (ภญ.) ปริมาณการซื้อโดยเฉลี่ยต่อเดือนประมาณ 1,000 ตันแต่บริษัทฯ ไม่ได้หักภาษี ณ ที่จ่าย เนื่องจากไม่เข้าหลักเกณฑ์ตามข้อ 3 ของคำสั่งกรมสรรพากร ที่ ท.ป.4/2528 ฯ ลงวันที่ 26 กันยายน พ.ศ. 2528 ซึ่งแก้ไขเพิ่มเติมโดยคำสั่งกรมสรรพากร ที่ ท.ป.56/2538 ฯ ลงวันที่ 19 พฤษภาคม พ.ศ. 2538 ที่กำหนดให้มีการหักภาษี ณ ที่จ่ายเฉพาะกรณีที่ผู้ซื้อซึ่งเป็นผู้ส่งออกหรือผู้ผลิตจ่าย เงินได้จากการรับซื้อยางให้แก่ผู้รับซึ่งเป็นบริษัทหรือห้างหุ้นส่วนนิติบุคคล
แนววินิจฉัย	: กรณีบริษัทฯ รับซื้อยางแผ่นและน้ำยางที่ได้จากต้นยางพาราจากเกษตรกรชาวสวนยางและ พ่อค้าคนกลางซึ่งเป็นบุคคลธรรมดาในหลายจังหวัดของภาคตะวันออกเฉียงเหนือ กรณีดังกล่าวบริษัทฯ ไม่มีหน้าที่ต้องหักภาษี ณ ที่จ่ายจากค่ายางแผ่นและน้ำยางที่ได้จ่ายให้แก่เกษตรกรชาวสวนยางและพ่อค้า คนกลางซึ่งเป็นบุคคลธรรมดาดังกล่าว เนื่องจากตามข้อ 3 ของคำสั่งกรมสรรพากร ที่ ท.ป.4/2528 ฯ ลงวันที่ 26 กันยายน พ.ศ. 2528 กำหนดให้มีการหักภาษีเงินได้ ณ ที่จ่าย สำหรับการรับซื้อยางแผ่น หรือยางชนิดอื่น เฉพาะกรณีที่มีการจ่ายเงินให้แก่ผู้รับ (ผู้ขายยางพารา) ที่เป็น บริษัทหรือห้างหุ้นส่วนนิติบุคคลเท่านั้น

ข้อหารือ	: บริษัท A. ได้หารือภาษีมูลค่าเพิ่ม กรณีประกอบกิจการผลิตและขายผลิตภัณฑ์จากยางพารา ประเภทยางแท่ง (เอสทีอาร์ 5 แอล), น้ำยางข้นและ SKIM BLOCK ทั้งในประเทศและส่งออก บริษัทฯ จะต้องจดทะเบียนภาษีมูลค่าเพิ่มหรือไม่
แนววินิจฉัย	: กรณีการผลิตและขายสินค้าประเภทยางแท่ง, น้ำยางข้นและ "SKIM BLOCK" หรือ "ยางอบ อัดเป็น BLOCK" ซึ่งประเภทหลังนี้เป็นการนำเศษน้ำยางที่เหลือจากการผลิตน้ำยางข้นนำมาใส่น้ำกรด และสารเคมีเพื่อรักษาสภาพ ให้เนื้อยางจับตัวกันลอยขึ้นมา แล้วนำยางเข้าเครื่องรีดเป็นแผ่นบาง ใช้น้ำ ล้างสารเคมีและกรดออกจากเนื้อยาง หลังจากนั้นเมื่อได้ยางที่บางก็จะนำผ่านเข้าเครื่องตัดทำเป็นชิ้น เล็กๆ นำเข้าอบอัดเป็น BLOCK เข้าลักษณะเป็นพืชผลทางการเกษตร บริษัทฯ ขายยางแท่ง, น้ำยางข้น และ SKIM BLOCK ภายในประเทศ จึงได้รับยกเว้นภาษีมูลค่าเพิ่ม ตามมาตรา 81(1)(ก) แห่ง ประมวลรัษฎากร แต่อย่างไรก็ดี หากบริษัทฯ ประสงค์จะเข้ามาในระบบภาษีมูลค่าเพิ่ม บริษัทฯ มีสิทธิ แจ้งต่ออธิบดีกรมสรรพากรตามแบบที่อธิบดีกำหนด เพื่อขอจดทะเบียนภาษีมูลค่าเพิ่มตามมาตรา 81/3(1) แห่งประมวลรัษฎากร ส่วนการที่บริษัทฯ ได้ขายสินค้าดังกล่าวเพื่อการส่งออก เข้าลักษณะเป็นการขาย ตามมาตรา 77/1(8) แห่งประมวลรัษฎากร บริษัทฯ มีหน้าที่เสียภาษีมูลค่าเพิ่มตามมาตรา 82(1)แห่ง ประมวลรัษฎากรโดยได้รับสิทธิเสียภาษีมูลค่าเพิ่มในอัตราร้อยละ 0 ตามมาตรา 80/1(1) แห่ง ประมวลรัษฎากร
